An advance directive includes both a "living will" (described above) as well as a durable power of attorney for health care. The DPOA/Health Care form allows the user to designate the person who will make health care decisions for you if you can't make them yourself. This is a legal grant of authority to the person you trust to speak for you, and both state and federal courts have ruled these enforceable if they are properly signed and witnessed. The "living will" portion guides the health care agent in his dealings with the doctor on your behalf. Easy to use advance directives like Five Wishes (which meets Nevada legal requirements) cover both these areas. --Paul Malley, President, Aging with Dignity, a national non-profit organization.
